KARACHI: A functionary of AN anti-terrorism court has recommended to police to look at the likelihood of cancellation of a case lodged against Geo TV when it broadcast a programme whose contents were deemed profane.

An FIR was lodged on the grievance of a professional person in could against the management of Geo TV, Shaista Lodhi, the host of Utho Jago Pakistan programme, and a few others on charges that they airy objectionable content within the morning show.

Abdul Maroof, special official of ATC-III, wrote a letter to the SHO of Mithadar police headquarters on Sat, stating that, in his read, basic parts of criminal liability were missing within the case owing to absence of “mens rea”. He argued that the offence caused to viewers was accidental.

(“Mens rea” may be a legal term which accurately suggests that “guilty mind”. This forms the premise for a notion that those while not decent mental capability can't be judged guilty of against the law. In courts, “mens rea” should be established to prove that against the law has been committed.)

Maroof maintained that since lodging a case in respect of broadcasting offences was barred underneath Section thirty four of the Pemra Ordinance 2002, the case had become hot, adding that the contents alleged within the FIR fell inside the scope of broadcasting offences case was lodged at Mithadar police headquarters underneath Sections 295-A [deliberate and malicious acts meant to outrage non secular feelings of any category by insulting its faith or non secular beliefs], 298-A [use of disparaging remarks, etc in respect of the Holy Prophet (PBUH)] and thirty four (common intention) of Pakistan legal code, browse with Section seven of Anti-terrorism Act 1997.
